No, only you or a lawyer can represent you in court. As a self-represented litigant, you speak for your own case and present your evidence. What this service does represent is your voice through your evidence and documentation. This service will teach you how to document for the level of court you appear in and how to present evidence according to the court rules.
A Divorce Consultant does not offer legal advice but does offer clear and accurate legal information.
A Divorce Consultant works alongside you to complete your self-represented legal documentation, guiding you through the terminology and process, explaining what is occuring at every stage, with your voice and input.
A Divorce Consultant will prepare you for each step, whether through mediation, family management conferences, judicial case conferences, or court appearances.
A Divorce Consultant will assist you in building a plan that is right for you and your family, whether you settle amicably or through court.
While having a lawyer has always been the standard reaction to hearing the word divorce, the fact is even a contested divorce does not require a lawyer.
The Provincial Court does not grant divorces, only the Supreme Court does.
The Provincial Court does not manage the division of assets and debts, only Supreme Court does.
You do not need to file for a divorce in order to develop parenting plans, apply for parenting time, apply for child support, apply for spousal support, or apply for rights to a companion animal. These matters can be dealt with before filing for divorce and are managed in Provincial Court.
You do need a divorce to get remarried.
You must be separated for a minimum of one year to be granted a divorce. NOTE: exceptions are adultery or cruelty.
All provisions for children must be satisfied before being granted a divorce (ie. no support arrears, appropriate parenting plans in place).
A divorce is official 31 days after the court has signed the order.
All matters are eligible to be mediated by agreement, outside of court through negotiation, including the division of assets and debts, if you are on amicable terms with your ex.
Most Provincial Court family law matters must be heard at a Family Management Conference (FMC) before a court date will be granted.
Most Supreme Court family law matters must be heard at a Judicial Case Conference (JCC) before a court date will be granted.
